Terms of Service

These Terms of Service ("Terms") govern your access to and use of the services provided by Fidensa LLC ("Fidensa," "we," "us," or "our"), including the website at fidensa.com ("Website"), the Fidensa API ("API"), the Fidensa MCP server, certification badges, and all related services (collectively, the "Services").
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.
1. Description of Services
Fidensa is an independent certification authority for AI capabilities. We evaluate AI capabilities — including MCP servers, Skills, rules files, sub-agents, hooks, and plugins — through a multi-stage verification pipeline that includes functional testing, adversarial testing, supply chain analysis, security scanning, and behavioral fingerprinting. The results of these evaluations are published as certification contracts containing trust scores, security assessments, behavioral guarantees, and related data ("Certification Data").
The Services include:
- Website. Public access to certification records, trust scores, methodology documentation, and related content.
- API. Programmatic access to Certification Data through the attestation API, search API, and related endpoints.
- Badges. Dynamically generated SVG badges reflecting certification status, available for embedding by capability publishers.
- MCP Server. A published MCP server (@fidensa/mcp-server) that provides structured access to Certification Data for AI agents.
- Consumer Reporting. A mechanism for registered consumers to submit experience reports regarding certified capabilities.
2. Certification Data Disclaimer
Certification Data is informational and provided on an "as-is" basis.
Fidensa certifications represent our independent assessment of a capability at the time of evaluation, based on the methodology described in our published documentation. They are not a guarantee, warranty, or endorsement of any capability's fitness for a particular purpose, safety, security, or reliability.
- Trust scores and grades reflect pipeline observations. They are derived from automated testing, static analysis, and structured evaluation. They do not represent a comprehensive assessment of all possible behaviors or failure modes.
- Certifications are point-in-time. A capability may change after certification. While Fidensa monitors for changes and re-certifies periodically, the certification reflects the state of the capability at the version and date specified in the certification contract.
- Behavioral guarantees are evidence-based, not absolute. The behavioral guarantees in a certification contract describe what Fidensa's pipeline observed during testing. They do not guarantee that the capability will always behave as described in all environments and conditions.
- Security findings reflect known vulnerabilities. Fidensa's security analysis covers known vulnerability databases, supply chain analysis, and behavioral security testing. It does not guarantee the absence of undiscovered vulnerabilities.
- You are responsible for your own trust decisions. Fidensa provides evidence to inform trust decisions. The decision to use or not use any capability remains yours.
3. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable laws.
- Attempt to interfere with, compromise, or disrupt the Services or their underlying infrastructure.
- Submit false, misleading, or fraudulent experience reports through the Consumer Reporting mechanism.
- Create multiple consumer identities to circumvent rate limits or manipulate certification scores.
- Scrape, crawl, or use automated means to access the Services in a manner that degrades performance, except through published API endpoints at their documented rate limits.
- Reverse-engineer, decompile, or attempt to extract the source code of the certification pipeline or scoring algorithms.
- Misrepresent or falsely claim Fidensa certification status for any capability.
- Use Certification Data to defame, harass, or unfairly disparage capability publishers.
4. API Usage Terms
4.1 Access Tiers
The API is available at multiple access tiers as described in our documentation. The Open tier (attestation endpoint, badge URLs, public key endpoint) is available without authentication. Higher tiers require registration and may require payment.
4.2 Rate Limits
All API access is subject to rate limits as documented for each tier. Exceeding rate limits may result in temporary throttling or suspension of access.
4.3 API Keys
If you register for an API key, you are responsible for maintaining its confidentiality. You are responsible for all activity that occurs under your API key and must notify Fidensa immediately if you become aware of unauthorized use.
4.4 Availability
Fidensa strives to maintain API availability but does not guarantee uninterrupted access. The API is provided on an "as-is" basis. We may modify, suspend, or discontinue any aspect of the API at any time with reasonable notice where practicable.
5. Consumer Identities and Experience Reports
5.1 Registration
To submit experience reports, you must register a consumer identity. By registering, you agree to submit only truthful and accurate experience reports based on your genuine experience with certified capabilities.
5.2 Cryptographic Keys
Upon registration, Fidensa generates an ECDSA P-256 keypair for your consumer identity. The private key is returned to you and is not retained by Fidensa. You are responsible for secure storage of your private key and must notify Fidensa immediately if it is compromised.
5.3 Report Integrity
Experience reports must accurately reflect your genuine experience. Coordinated campaigns to manipulate certification scores, submission of fabricated reports, or systematic abuse of the reporting mechanism may result in suspension of your consumer identity and permanent quarantine of associated reports.
5.4 Dispute Resolution
If you believe a certification is inaccurate based on your experience, you may submit a dispute through the process described in our documentation. Fidensa will evaluate disputes in good faith and publish resolutions transparently.
6. Intellectual Property
6.1 Fidensa Marks
"Fidensa," the Fidensa logo, certification tier names (Certified, Verified, Evaluated), and certification badges are the intellectual property of Fidensa LLC. You may not use these marks in any manner that suggests endorsement by or affiliation with Fidensa, except as expressly permitted below.
6.2 Badge Usage
Publishers of capabilities that hold a current, valid Fidensa certification may display the corresponding badge in their documentation, README files, package listings, and marketing materials, provided that the badge accurately reflects the current certification status (using the dynamic badge URL, not a static image), links to the capability's certification detail page on fidensa.com, and is not modified or used in a misleading context. If a certification is suspended, revoked, or expires, the publisher must remove the badge within a reasonable time.
6.3 Certification Data
Certification Data published on fidensa.com and through the API may be referenced, cited, and linked to freely. You may quote trust scores, grades, and certification status in your own materials with proper attribution to Fidensa. You may not bulk-reproduce Certification Data in a manner that creates a competing service or strips attribution.
6.4 Your Content
By submitting experience reports or other content to Fidensa, you grant Fidensa a non-exclusive, worldwide, royalty-free license to use, store, process, and display that content in connection with the Services, including aggregation into certification scores.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Fidensa LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to your use of the Services or reliance on Certification Data, regardless of the theory of liability.
Fidensa's total aggregate liability arising out of or related to these Terms shall not exceed the amounts you have paid to Fidensa in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.
These limitations apply even if Fidensa has been advised of the possibility of such damages and even if a remedy set forth herein is found to have failed its essential purpose.
8. Disclaimer of Warranties
The Services and all Certification Data are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. Fidensa disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, and non-infringement.
Fidensa does not warrant that the Services will be uninterrupted, error-free, or secure, or that any defects will be corrected.
9. Indemnification
You agree to indemnify, defend, and hold harmless Fidensa LLC and its members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any rights of any third party.
10. Modifications to Terms
Fidensa may modify these Terms at any time. We will provide notice of material changes by updating the "Last Updated" date at the top of this page. Your continued use of the Services after any modification constitutes your acceptance of the modified Terms.
11. Termination
Fidensa may suspend or terminate your access to the Services at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your rights under these Terms will immediately cease. Sections 2, 6, 7, 8, 9, and 12 survive termination.
12. Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Wake County, North Carolina.
13. Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
14. Entire Agreement
These Terms constitute the entire agreement between you and Fidensa regarding the Services and supersede all prior agreements and understandings, whether written or oral.
